IV. TAXES <br />TENANT recognizes and understands that this Lease Agree- <br />ment may create a possessory interest subject to property <br />taxation, and that TENANT may be subject to the payment of <br />property taxes levied on such interest. <br />V. IMPROVEMENTS <br />TENANT shall make no structural improvements on the leased <br />property without first having obtained written consent of <br />CITY. Any structural improvements on the leased property <br />shall become at once a part of the leased property and belong <br />to CITY. TENANT shall keep the leased property free of any <br />liens arising out of any work performed, material furnished, or <br />obligations incurred by TENANT. <br />VI. INDEMNITY <br />TENANT agrees to indemnify and save harmless CITY and its <br />officers, agents and employees, against any and all damages to <br />property, and injuries to or death of any person or persons, <br />including property and employees or agents of CITY, and shall <br />defend, indemnify and save harmless CITY, and its officers, <br />agents and employees, from any and all claims, demands, suits, <br />actions, or proceedings of any kind or nature, including, but <br />not by way of limitation, workers' compensation claims, of or <br />by anyone whomsoever, in any way resulting from or arising out <br />of TENANT'S use of the leased property pursuant to this Agreement. <br />-6- <br />
