Contractors Pollution Liability Policy <br />Policy Period <br />The term policy period means the period set forth in the Declarations, or any <br />shorter period arising as a result of cancellation. <br />Policy Year <br />The term policy year means the separate annual year period whenever the <br />policy period set forth in the Declarations is either for a two or three year time <br />period. <br />Pollution Condition <br />The term pollution condition means the discharge, dispersal, release or <br />escape of smoke, vapors, fumes, acids, alkalis, toxic chemicals, liquids or <br />gases, waste materials or other irritants, contaminants or pollutants into or <br />upon land, the atmosphere or any watercourse or body of water which results <br />in bodily injury or property damage. A continuous, related, repeated, or <br />similar series of discharges, dispersals, releases, or escapes of pollutants at <br />or from a site shall constitute a single pollution condition. <br />Related pollution conditions are those pollution conditions that arise out of , <br />are based on, relate to or are in consequence of, the same facts, <br />circumstances or situations. <br />Property Damage <br />The Term property damage means: <br />1. Physical injury to or destruction of tangible property including the <br />resulting loss of use thereof; and <br />2. Costs expended by the named insured to evaluate, investigate, cleanup, <br />remediate or monitor any environmentally contaminated site. <br />3. Loss of use of tangible property that has not been physically injured or <br />destroyed; provided that such physical injury or destruction, clean up <br />costs and/or loss of use are caused by a pollution condition arising out of <br />the performance by the named insured of operations insured by this <br />policy. <br />Waste The term waste means any discarded materials of any kind, including those <br />materials to be recycled, reconditioned, reclaimed, or disposed of. <br />III. LIMITS OF INSURANCE <br />A. MAXIMUM LIMITS OF LIABILITY <br />The Company's maximum Limit of Liability hereunder shall not exceed the separate limits of <br />liability for damages and claims expenses specified in the Declarations, irrespective of the <br />following: <br />1. The number of claims made; or <br />2. The number of persons or organizations making claims; or <br />3. The number of persons covered hereunder; or <br />4. The number of pollution conditions which arise; or <br />5. The types of damages awarded. <br />B.
