t <br />Recipient: City of Santa Ana, California Grant Number: B-84-AA-06-0615(P) <br />EXHIBIT E <br />REQUIRED EVIDENTIARY MATERIALS <br />The evidentiary materials to be submitted by the Recipient for the approval of <br />3 the Secretary shall include the applicable provisions of Article IX of this Grant <br />Agreement and shall consist of the following: <br />I <br />5 <br />(a) All governmental approvals and permits necessary for the commencement of <br />to the Recipient and Non -Recipient Activities shall have been obtained. <br />(b) Evidence of this commitment shall be a written certification from <br />9 Recipient, signed by the chief executive officer, in accordance with Section 10.02 <br />0 of this Grant Agreement, that all such governmental approvals and permits have been <br />A obtained. <br />II <br />2 <br />3 (a) Title to all land necessary for the Project, except land to be acquired <br />.4 with Grant Funds, shall be held by Recipient or the appropriate Participating <br />5 Party. <br />(b) Evidence of this commitment shall be in accordance with Section 10.10 of <br />:? this Grant Agreement. <br />III <br />8 <br />-9 (a) Recipient and Developer shall enter into an agreement which shall contain <br />.0 provisions consistent with the following: <br />(1) Recipient shall agree to carry out the Recipient Activities set <br />rl forth in subparagraphs (a), (b), (c) and (d) of Exhibit B to this Grant Agreement. <br />13 (2) Developer shall agree to carry out all Non -Recipient Activities <br />�4 ascribed to Developer in Exhibit C to this Grant Agreement. The agreement shall <br />15 set forth the scope of the work, its location, and the obligation of Developer to <br />,6 invest not less than $6,464,172 of private funds and cash equity in Project <br />rl Element A. <br />e (3) Recipient shall be obligated to make a loan to Developer of not more <br />than $552,000 of Grant Funds (the "UDAG Loan"), which shall be used for the partial <br />50 50 financing of the construction of Project Element A in accordance with Page 2 of <br />31 Exhibit D to this Grant Agreement.
