SECURED BY DEED .OF TRUST <br />(INSTALLMENT NOTE - INTEREST INCLUDED) <br />$32 310.0 <br />Escrow No: 88079 A/B <br />Re:I306 North Bewley „St. <br />Santa Ana, California <br />Dated: F vqy, <br />FOR VALUE RECEIVED, we/I jointly and severally, <br />promise to pay the City of Santa Ana, a municipal corporation, or <br />order, at 20 Civic Center Plaza, Santa Ana, California 92701, or <br />at such other location as the holder hereof may, from time to <br />time designate, the sum of $ THIRTY-TWO THOUSAND THREE HUNDRED <br />TEN AND NO 100 - - - ----dollars ($32,310.00 ) with <br />interest from , 1992 , on unpaid principal at the <br />rate of five percent 5.001 per annum; principal and interest <br />payable in installments of $ 5�7 5�51 on the _�_�__ da of each <br />calendar month, beginning on the day of �e , 1992, and <br />continuing until the said principal and interest have been paid. <br />Each payment shall be credited -first on the <br />interest then due and the remainder on principal; and interest <br />shall thereupon cease upon the principal so credited. The maker <br />of this Note promises to pay to the holder hereof a "late" charge <br />of $10.00 as liquidated damages, and not as a penalty, for each <br />installment more than ten (10) days in arrears. Upon default in <br />payment on any installment, the balance of this obligation shall <br />become due immediately at the option of the holder hereof. <br />ram` <br />In the event that the real property which is the <br />subject of the Deed of Trust securing this Note, or any part <br />hereof, or any interest therein, is sold, agreed to be sold, <br />conveyed or alienated by the maker of this Note, or by operation <br />of law or otherwise, at the option of the holder thereof and <br />without demand or notice, this obligation shall become due and <br />payable in full. Consent to one such transaction by the holder <br />hereof shall not be deemed to be a waiver of the right to require <br />consent of the holder of this Note to future or successive <br />transactions. <br />In the event that it is determined by a court of <br />competent jurisdiction that the real property which is the <br />subject of Deed of Trust securing this note is used, maintained <br />or occupied, by the undersigned or by any other person or <br />persons, in violation of any provision of any code or ordinance <br />of the City of Santa Ana, then at the option of the holder hereof <br />and without demand of notice, this obligation shall become due <br />and payable in full. <br />The maker of this Note shall have the right to <br />prepay this Note in whole or in part without penalty or premium <br />at any time. <br />said principal sum shall be payable in lawful <br />money of the United States of America. If action is instituted <br />on this Note, the maker of this Note promises to pay such sum as <br />the court may fix as attorney fees.
