Cancellations: <br />If any order is cancelled prior to the issuance of a policy or the <br />consummation of a transaction, but segt1ert to the issuance of a <br />report or guarantee, or if clear title'cannot be delivered due to <br />matters of record, the charges shall b'^ those incurred up to the date <br />of cancellation as provided for herein for any services rendered. If <br />any order is cancelled prior to the issuance of the report or guarantee, <br />the charge may be waived, depending uptn the amount of work done prior <br />to the date of cancellation. <br />IV. DELIVERY AND PAYMENIT <br />The first party shall commence work immediately upon receipt of the <br />order for any service herein stated and shall pursue and complete <br />the services requested as expeditiously as possible. <br />Continuation reports covering the filing of Lis Pendens shall be <br />forwarded within five (5) days, at no additional charge, after <br />receiving a request for such continuation from second party and <br />such reports may be returned for insertion of recording reference <br />if requested by second party. <br />Policies shall be written and delivered within five (5) days of the <br />filing of a deed or the entering of the final order of condemnation <br />or decree quieting title. <br />All invoices shall be issued in triplicate at the time each service <br />is performed and payment therefor shall be made by second party. <br />V DEFINITION OF PARCEL. <br />A. Any lot or lots thereof in a single subdivision vested in the <br />same ownership which ownership has been covered by a report or <br />policy of title insurance within the same block of a dedicated <br />tract, subdivision or Licensed Surveyor's Map where said lots <br />or blocks are not divided or separated by a public or private <br />street, highway and/or road. If said lots or blocks are divided <br />by a public or private street, highway and/or road, as shown by <br />the public records, each portion thereof so divided shall be <br />deemed to be a separate parcel even though the portions so divided, <br />are in the same ownership. <br />B. All lands vested in the same ownership situated entirely within <br />one government survey section where said land is not divided by <br />any public or private street, highway and/or road. If said land <br />is divided by a public or private street, highway and/or road, <br />such portion or portions thereof so divided shall be deemed to be <br />a separate parcel even though such portion or portions so divided <br />are in the same ownership. <br />C. Any contiguous land vested in the same ownership situated entirely <br />within one rancho which has not been sectionized or in one swamp <br />or overflow survey_ where said land is not divided by any public <br />or private street, highway and/or road.
