The City agrees not to issue any permit to any person other <br />than Developer for a bus shelter in 'the Main Street sidewalk <br />adjacent to the Property, except in either of the following <br />circumstances: <br />(a) The Developer has not installed a bus shelter, either in <br />the Main Street sidewalk adjacent to the Property or on <br />the Property adjacent to such sidewalk, within one (1) <br />year after the date of this Agreement; <br />(b) The Developer has removed the previously constructed bus <br />shelter as part of the reconstruction of the Main Street <br />sidewalk at the time Developer proceeds with Phase II of <br />the Development and has failed to construct a new bus <br />shelter, either in the Main Street sidewalk adjacent to <br />the Property or on the Property adjacent to such <br />sidewalk, at the time Developer completes such sidewalk <br />reconstruction. <br />Any bus shelter constructed by Developer in the sidewalk.adjacent <br />to the Property shall comply with City standards for bus shelters <br />in the public right-of-way in effect at such time. <br />(3) Lawson Nay Improvements. <br />It shall be the obligation and responsibility of <br />Developer to design, bid and construct certain street improvements <br />to and along Lawson Way as more particularly specified in the <br />conditions of approval of the Map ("Lawson Way Improvements"). <br />Developer's construction of the Lawson Way Improvements shall occur <br />concurrently with the construction of Phase I development. <br />(4) Signalization. <br />The Developer shall be responsible for the design, and/or <br />construction and/or reconstruction of traffic signals and bear the <br />cost with respect thereto, all in accordance with and as'more <br />specifically set forth in the conditions of approval of the Map. <br />(5) Storm Drain Improvements. <br />The Developer shall design, bid, construct (in coordina- <br />tion with the Owens Drive Improvements) and bear the expense of the <br />construction of storm drain improvements to handle drainage and <br />water runoff from the Property in accordance with and subject to <br />the terms of the conditions of approval of the Map. The Developer <br />shall receive full credit against any drainage assessment fee <br />imposed on the Development. <br />17 <br />
