WHEREFORE, in consideration of the mutual and <br />respective promises, the parties hereto do hereby agree as follows: <br />1. The CITY'S RFP and the CONSULTANT'S PROPOSAL <br />are incorporated herein in their entirety as though set forth in <br />full. <br />2. CITY accepts the PROPOSAL and CONSULTANT agrees <br />to perform all services and to fulfill all requirements of the RFP <br />and the PROPOSAL. <br />3. CITY agrees to furnish services and documents <br />indicated in the RFP and the PROPOSAL. <br />4. CITY shall pay CONSULTANT monthly for the <br />actual services satisfactorily provided to the project by <br />CONSULTANT. Said services shall be paid for in accordance with the <br />unit costs and hourly rates set forth in the Fee Schedule included <br />in CONSULTANT's PROPOSAL. The compensation for the above shall not <br />exceed Two Hundred and Thirty -One Thousand and Fifty Dollars <br />($221,950). CONSULTANT shall cease work when value of services <br />provided by CONSULTANT reaches the above -mentioned amount. This <br />agreement contains a 10% contingency, which can bring the total <br />amount to $244,145 if additional services are authorized in writing <br />by the CITY'S Executive Director of the Public Works Agency. This <br />agreement may also be extended for one year by the CITY'S Executive <br />Director of Public Works Agency or his authorized representative. <br />At the time of extension, the unit cost and hourly rates will be <br />adjusted per the consumer index. <br />K <br />
