1zool --�50 <br />CHANUE ORDER/AMENDMENT TO CON i RUCT: <br />This Amendment, made and entered Into this 314�r day of 0. A-� 2002 <br />by and between Mobile Home Mansions, a California (hereinafter "MHM"), and the <br />Oy, of Santa Ana, a charter city and municipal corporation organized and existing <br />under <br />I the Constit-uti on and laws of the State of California (hereinafter "City"). <br />RECITALS <br />A. City and MHM entered into a Purchase Contract dated December 2001 <br />whereby the City purchased a piece of equipment (a mobile home) from <br />MHM in which <br />to house certain personnel during remodeling/construction <br />work. <br />B. Costs for seismic retrofitting and air conditioning were not included in the bid <br />for the mobile home purchased by the City. Said seismic retrofitting is <br />:D <br />required for the health and safety reasons. <br />C. Pursuant to Section 2-1 of the Santa Ana Municipal Code, the City Manager <br />has the authority to bind the City on change orders to city contracts for <br />materials, supplies or equipment without further council approval, so long as <br />the such change order does not increase the city's expenditure obligation <br />under said contract more than 10% or the amount of $ 10,000. <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter <br />contained and made, and subject to all of the terms and conditions of said Agreement as hereby <br />amended, the parties hereto do hereby agree as follows: <br />1. The scope of services of said Purchase Contract shall be expanded to include the <br />required seismic retrofitting and air conditioning. <br />2. The compensation shall be amended to include a $4,195 increase (See Invoice <br />attached hereto as Exhibit A), making the total compensation under the Purchase <br />Contract $53,890.50. <br />3. Except as hereinabove modified, the terms and conditions of said Agreement remain <br />unchanged and in full force and effect. <br />IN, WITNESS WHEREOF, the parties hereto have executed this Change <br />Order/Amendment to said Purchase Contract the date and year first above written. <br />ATTEST; <br />ATRICIA E.
