EXHIBIT B <br />ANNUALIZED CAPITAL COMPONENT <br />The Annualized Capital Component shall be computed using only the following incurred <br />costs by OCWD for the Project: <br />a. Design and construction management services. <br />b. Construction of Project facilities, more particularly described in Exhibit A. <br />C. Agency administration of the Project design, construction, and start-up, not to <br />exceed three (3) percent of construction costs unless otherwise approved in <br />writing by Metropolitan. <br />d. Permits; including required data collection. <br />C. Land, right-of-way and easements for the Project described in Exhibit A. <br />f. Environmental documentation and mitigation measures directly related to the <br />implementation or operation of the project and required to comply with applicable <br />environmental permits and laws, including but not limited to the California <br />Environmental Quality Act, National Environmental Policy Act, and the <br />California and Federal Endangered Species Acts. Environmental documentation <br />costs shall commence with the Notice of Preparation and conclude with the filing <br />of the Notice of Determination. <br />g. All contributions as outlined in Section 5.3 of this Agreement, including but not <br />limited to payments from IRWD to OCWD for excess capacity purchases or <br />groundwater conveyance through the Project, shall be treated as negative capital <br />cost values for the purpose of computing the Annualized Capital Component. <br />2. Cost of the following items shall not be used to calculate the Annualized Capital <br />Component: <br />a. Storm drains, sewer collection systems, and treatment and distribution facilities <br />beyond the Project's points of connection. <br />b. Existing facilities, land, right-of-way, and easements. <br />C. Feasibility studies. <br />d. Facilities necessary to meet the National Pollution Discharge Elimination System <br />and California Waste Discharge requirements. <br />e. Deposit of any reserve funds required as a condition of financing. <br />Agreement 22156 -15- <br />
