Section 6 •:+ . firms and Conditions <br />No, Motorola is only supplying a network controller (not frequency sensitive) <br />and replacement radio modems that you should already be licensed for. <br />6.2.8 Is all equipment year 2000 compliant <br />I have received a "soft" copy of a new Communications System Agreement <br />(CSA) with verbiage that incorporates the Year 2000 ready warranty in Section 6,2.8. I <br />will provide you hard copies of the new CSA so that Motorola can retain document <br />control. For your reference, the section will read as follows: <br />Section 8 Lactated Warranty <br />For the first 120 days after initial shipment of Motorola Software, or, if the <br />Motorola Software is provided pursuant to a Communications System Agreement <br />between Motorola and Licensee, for the Warranty Period specified in such <br />Agreement, Motorola warrants that the Motorola Software, when used properly, <br />will be free from reproducible defects that materially vary from its published <br />specifications. Motorola does not warrant that Licensee's use of the Motorola <br />Software or the Products will be uninterrupted or error -free or that the Motorola <br />Software or the Products will meet Licensee's particular requirements. Motorola <br />warrants that each hardware, software, and firmware product delivered under this <br />Agreement and listed as "Year 2000 Compliant" shall be able to accurately <br />process date data (including, but not limited to, calculating, comparing, and <br />sequencing) from, into, and between the year 1999 and the year 2000, including <br />leap year calculations, when used in accordance with the product documentation <br />provided by Motorola, provided that all listed data or unlisted products (e.g., <br />hardware, software, firmware) used in combination with such listed product <br />properly exchange data with it, except that the RNC 3000 software will not be <br />Year 2000 ready until April 30, 1998. This warranty shall extend through June 1, <br />2000, The remedies available for breach of this warranty shall be as defined in, <br />and subject to, the terms and limitations ofMotorola's Standard Commercial <br />Warranty.
