EXHIBIT "C" <br />RECORDING REQUESTED BY, ) <br />AND WHEN RECORDED MAIL TO. ) <br />City of Santa Ana ) <br />20 Civic Center Plaza, 6th Floor ) <br />Santa Ana, California 92702 ) <br />Attn: Executive Director ) <br />This document is exempt from <br />payment of a recording fee <br />pursuant to Government Code <br />Sections 27383 and 6103. <br />NOTICE OF AFFORDABILITY RESTRICTIONS ON <br />TRANSFER OF PROPERTY <br />This Notice of Affordability Restrictions on Transfer of Property (or "Notice <br />of Affordability Restrictions") is executed and recorded pursuant to Section 65915 <br />of the California Government Code, and affects that certain real property generally <br />located at in the City of Santa Ana, California ("City") as legally <br />described in Exhibit A hereto ("Property"), The City of Santa Ana, a charter city <br />and municipal corporation of the State of California (referred to herein as "City"), <br />and ("Developer/Property Owner") have entered into that certain <br />Density Bonus Housing Agreement dated as of, ("Density Bonus Housing <br />Agreement"). <br />1. The Density Bonus Housing Agreement provides for affordability <br />restrictions and restrictions on the transfer of the Property, as more particularly set <br />forth in the Density Bonus Housing Agreement. A copy of the Density Bonus <br />Housing Agreement is on file with City as a public record and is deemed <br />incorporated herein. Reference is made to the Density Bonus Housing Agreement <br />with regard to the complete text of the provisions of such agreement and all <br />defined terms therein, which provides for affordability restrictions and restrictions <br />on the transfer of the Property. <br />2. For a period commencing upon the date on which the Affordable Unit <br />receives all required occupancy permits from the City and terminating on the fifty- <br />fifth (55th) anniversary thereof, the Property may only be transferred to another <br />1 <br />
