Program Income <br />County’s Maximum Obligation herein shall be reduced by the amount of any program income earned by <br />Subrecipient, from sources other than County, as a result of this Contract or the services provided by <br />Subrecipient pursuant to this Contract. <br /> <br />It shall be the responsibility of Subrecipient to inform the County in writing of any income earned as a <br />result of this Contract. <br /> <br />It is mutually understood that the State or Federal agency responsible for providing the funding for this <br />Contract may designate certain revenue of Subrecipient as Program Income. To be designated as Program <br />Income and therefore, as other than a cost off-set. Subrecipient shall do all of the following: <br /> <br />A. Submit a plan to the County for use of any and all proposed Program Income; and <br /> <br />B. Set-up and maintain a separate bank account for any proposed Program Income and account for any <br />and all such income received. <br /> <br />C. Report to County any and all Program Income received no later than thirty (30) days from the date of <br />receipt; record the amount received on Internal financial records; and indicate the amount received on the <br />monthly claim submitted to County. <br /> <br />County shall then forward the plan for the requested use of the proposed Program Income to the <br />appropriate State and/or Federal agencies for approval. <br /> <br />Subrecipient shall not spend any of the proposed Program Income unless or until such time as County <br />obtains authorization for the use of the Program Income from the responsible State and/or Federal agency <br />and provides Subrecipient with prior written approval for the use of the funds. <br /> <br />County may, in its sole discretion, issue future policy statements and/or instructions with respect to <br />Program Income. Subrecipient shall immediately comply with such policy statements and/or instructions. <br />18. Modification of Program Components and Service Levels <br />The Parties hereto agree that those program components and service levels detailed in various <br />Attachments of this Contract (i.e. Scope of Service, etc.) may be modified upon mutual written agreement <br />of the Administrator and Subrecipient so long as the total payments under this Contract are not increased <br />and the basic goals and objectives of the program are not altered. Should the Federal Government and/or <br />the State of California modify any program component and/or service level detailed in the various <br />Attachments then the County shall have the right to unilaterally modify this Contract to meet such <br />requirements. <br /> <br />A. County may at any time, unilaterally, by written notification to Subrecipient, make changes within the <br />general scope of this Contract, including, in the definition of services and tasks to be performed, the <br />manner in which services are performed, the time and place of performance thereof and additional related <br />provisions. Changes may be made when necessitated by changes in the WIOA Youth Program Services - <br />TBD operations or performance, the operations or performance of Subrecipient, or changes in applicable <br />EXHIBIT 1
