2. Any other information that is linked or linkable to an individual, such as medical, <br />educational, financial, and employment information <br />Treatment, Payment and Health Care Operations (TPO) include all the following: <br />1. Treatment means the provision, coordination, or management of health care and <br />related services, consultation between providers relating to an individual, or <br />referral of an individual to another provider for health care. <br />2. Payment means activities undertaken to obtain or provide reimbursement for <br />health care, including determinations of eligibility or coverage, billing, collections <br />activities, medical necessity determinations and utilization review. <br />3. Health Care Operations includes functions such as quality assessment and <br />improvement activities, reviewing competence or qualifications of healthcare <br />professionals, conducting or arranging for medical review, legal services and <br />auditing functions, business planning and development, and general business and <br />administrative activities including the creation of de -identified health information <br />as defined by these regulations. <br />Disclosure means the release, transfer, provision of access to, or divulging in any other <br />manner of information outside the entity holding the information. <br />Use means, with respect to individually identifiable health information, the sharing, <br />employment, application, utilization, examination, or analysis of such information within <br />an entity that maintains such information. <br />Personal Representative means a person who has authority under applicable law to make <br />decisions related to health care on behalf of an adult or an emancipated minor, or the <br />parent, guardian, or other person who is authorized under law to make health care <br />decisions on behalf of an un-emancipated minor. <br />Employees means all employees of Virtru as well as its temporary employees, interns, <br />independent contractors, trainees, and other persons in the performance of work for the <br />Company, its offices, programs or facilities. <br />Privacy Rules means the rules adopted by various state and federal agencies to implement <br />the requirements of the Health Insurance Portability and Accountability Act of 1996 <br />(HIPAA) and regulations promulgated under this Act as well as those obligations that <br />arise under the privacy and security standards adopted by the Health Insurance <br />Marketplaces, pursuant to 45 C.F.R. §155.260. <br />E.
