CITY OF SANTA ANA <br /> TABLE OF CONTENTS <br /> PROJECT NO.: 25-6030 <br /> TRAFFIC SIGNAL INSTALLATION AT SEGERSTROM AVENUE AND ROSEWOOD <br /> AVENUE <br /> NON-DISCRIMINATION CERTIFICATE <br /> Attention is directed to Section 1735 of the California Labor Code, as added by Chapter 643, <br /> Statutes of 1939,which reads as follows: <br /> "No discrimination shall be made in the employment of persons upon public works because of the <br /> race,religious creed,color,national origin,ancestry,physical handicap,medical condition,marital <br /> status, or sex of such persons except as provided in Section 1420, and every contractor for Public <br /> Works violating this Section is subject to all penalties imposed for a violation of the Chapter." <br /> A copy of the Certification of Nondiscrimination by Contractors is provided in the Bid Proposal <br /> section of these Contract Documents. <br /> STATEMENT REGARDING APPRENTICESHIP REQUIREMENTS <br /> Bidders shall be familiar with the requirements of Section 1777.5 of the California State Labor <br /> Code regarding employment of apprentices and shall submit a Statement Regarding <br /> Apprenticeship Requirements with the Bid Proposal. A copy of the Statement is provided in the <br /> Bid Proposal section of these Contract Documents. <br /> STATEMENT REGARDING"ANTI-KICK-BACK"REQUIREMENTS <br /> Bidders shall be familiar with, and shall agree to comply with,the Copeland"Anti-Kickback"Act <br /> (18 USC 74) as supplemented in the Department of Labor regulations (29 CFR, Part 3), and shall <br /> submit a Statement Regarding "Anti-Kickback" Requirements with the Bid Proposal. A copy of <br /> the Statement is provided in the Bid Proposal section of these Contract Documents. <br /> FLEET COMPLIANCE CERTIFICATION <br /> The City is a Public Works Awarding Body, as defined under Title 13 California Code of <br /> Regulations section 2449(c)(46). Accordingly, Bidders must submit, with their Bids, valid <br /> Certificates of Reported Compliance (CRC) for the Bidder's fleet and for the fleet(s) of its listed <br /> subcontractors (including any applicable leased equipment or vehicles). Bidder must additionally <br /> complete and submit the Fleet Compliance Certification, included in the Bid Documents. Failure <br /> to provide a CRC for the Bidder, and for all listed subcontractors,or failure to complete the Fleet <br /> Compliance Certification, may render the Bid non-responsive. <br /> CONSTRUCTION CONTRACT AGREEMENT, BONDS &INSURANCE <br /> The Construction Contract Agreement, Sample Bonds and Insurance Requirements are all <br /> included as appendices in the project Contract Documents. <br /> Following authorization by City Council to award a Construction Contract, written notification <br /> will be given by the AGENCY to the successful BIDDER who will,within ten(10)business days, <br /> submit to the Agency the completed and signed Construction Contract Agreement, a Performance <br /> Bond, a Payment Bond, and evidence of Worker's Compensation Insurance. <br /> Failure to execute a contract and submission of acceptable bonds and insurance as provided herein <br /> within the time limit above may be just cause for the annulment of contract award and the forfeiture <br /> of the bid proposal guarantee. <br /> xv <br />
