(25) <br /> <br />Prior to the issuance of a Certificate of Occupancy for either the second office <br />building in Phase I1 of the development or for a hotel, whichever comes first, the <br />applicant shall also deposit an additional $650,000 (as the remainder of its total <br />$750,000 commitment for the cost of mitigation measures) with the City, to be <br />used solely to fund mitigation measures which have been identified in any traffic <br />study or studies pursuant to Mitigation Measure 88. <br /> <br />Of the total $750,000, $250,000 may be used for traffic mitigation measures <br />located in either the City of Santa Ana or the City of Orange, and the balance of <br />the total shall be used solely for mitigation measures located in the City of Santa <br />Aha. <br /> <br />Any mitigation measures to be funded by the applicant shall be approved by the <br />City of Santa Ana, if located in said City, or by the City of Orange, if located in <br />said City. Each city shall have complete discretion to determine whether a <br />measure within its jurisdiction has adequate resident support and is otherwise <br />warranted. In addition, the property manager will require that parking personnel <br />patrol adjoining properties on a daily basis to enforce such provisions. This daily <br />patrol will be performed by a uniformed parking employee driving a utility vehicle that <br />will be signed to identify it as part of the Main Street Concourse Management. <br /> <br />The areas to be patrolled will be marked on a grid map of the streets surrounding Main <br />Street Concourse and will include Main Place along Main Street, surrounding <br />residential, and other appropriate areas. <br /> <br />The appearance of a patrol is a deterrent to offsite parking.
