29 RESOLUTION NO. 98- 013.1 ~ RESOLUTION OF THE CITY COUNCIL OF THE C~TY', OF ~ANT~ ANA APPROVING a cOoPERATION A~RE~MENT AND A PROJECT IMPLEMENTATION A~EEMENT .~ID M~KING ENVIRONMENTAL FINDINGS RELATED THERETO. WHEREAS, on or about January 4, 1988,'the City Council entered into that certain Development Agreement (the "Development Agreement") related to a ± 62 acre site commonly known as MacArthur Place (the "Project"); and WHEREAS, First American Financial Corporation as a potential buyer of a ± 40 acre portion of the Project(the ~Site"), and MacArthur Place LLC as successor in interest to the original owner of the Project, have requested that the City enter into that certain Project Implementation Agreement, on file with the Clerk of the Council, whereby the parties seek to clarify certain rights and obligations under the Development Agreement; and, WHEREAS, the Community Redevelopment Agency of the City of Santa Ana (the ~AgencY") has requested that the City enter into that certain Cooperation Agreement, on file with the Clerk of the Council, to assist the City in providing for the costs of certain public improvements to serve the Project and the Site. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS FOLLOWS: 1. The Project Implementation Agreement is hereby approved, and the Mayor is authorized and directed to execute same on behalf of the City, with such non-substantive changes as may be recommended by the City Attorney. 2. The Cooperation Agreement is hereby approved, and the Mayor is authorized and directed to execute same on behalf of the City, with such non-substantive changes as may be recommended by the City Attorney. 3. By Resolution No. 98-16, the Santa Aha Planning Commission made certain environmental finding, which the Council hereby finds adequate for its action herein.
