427 <br /> <br />RESOLUTION NO. 95-079 <br /> <br />A RESOLUTION OF THE' CITY COUNCL OF THE <br />CITY OF SANTA ANA AUTHORIZING THE <br />EXECUTIVE DIRECTOR OF THE PUBLIC WORKS <br />AGENCY TO APPLY FOR ARTICLE XIX TRANSIT <br />CAPITAL IMPROVEMENT FUNDS, AND TO <br />EXECUTE AN AGREEMENT FOR THE USE OF SUCH <br />FUNDS, ON BEHALF OF THE CITY OF SANTA.ANA <br /> <br /> WHEREAS, the Council has considered certain assurances to the California <br />Transportation Commission (CTC) related to the Santa Arm Regional Transportation <br />Parking Structure project, which are required to be submitted to the CTC as part of its <br />funding application process; and, <br /> <br /> WHEREAS, the Council hereby makes the assurance that public fixed-route transit <br />will be available to the facility; and, <br /> <br /> WHEREAS, the Council hereby makes the assurance that the City will provide for <br />security at the facility; and, <br /> <br /> WHEREAS, the City agrees to own the parking structure and maintain the parking <br />structure at City expense; and, <br /> <br /> WHEREAS, the City agrees not to charge Amtrak for parking; and, <br /> <br /> WHEREAS the City intends to use existing local transportation funding for regular <br />operation and maintenance costs; and, <br /> <br /> WHEREAS, the City will apply for any available funding from the State for major <br />maintenance expenses as they arise; and, <br /> <br /> WHEREAS, the City has the financial and institutional ability to implement the <br />project and is empowered to: let a contract; to sue or be sued by another entity or person; <br />and to carry out its other responsibilities and duties; and, <br /> <br /> WHEREAS, this project will be available to the general public, or its primary <br />purpose will be to benefit the public and does not benefit a private entity or individual; and, <br /> <br /> WHEREAS, the matching funds required for said project are available and <br />committed to this project; and, <br /> <br /> WHEREAS, if the project exceeds available State funds, the City will provide the <br />additional local funds needed to complete the project, or the project will be reduced in <br />scope; and, <br /> <br /> WHEREAS, the City will comply with the CTC's Hazardous Waste Identifications <br />and Clean-up Policy for Rail Right-of-Way; and, <br /> <br /> <br />
