457 <br /> <br />RESOLUTION NO. 98- o 84 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA ESTABLISHING AN <br />APPLICATION FEE FOR A LAND USE <br />CERTIFCATE FOR AN EXTERIOR TELEPHONE <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />HEREBY RESOLVES, DETERMINES, AND DECLARES AS <br />FOLLOWS: <br /> <br /> WHEREAS, pursuant to Zoning Ordinance Amendment No. 98-05, the City requires <br />that persons seeking to install exterior pay telephones shall first obtain approval by the City <br />ora Land Use Certificate; and <br /> <br /> WHEREAS, Zoning Ordinance Amendment No. 98-05 requires that the City <br />Cotmcil shall from time to time set by resolution the application fee to be charged to persons <br />filing an application for a Land Use Certificate to install one or more exterior pay <br />telephones; and <br /> <br /> WHEREAS, the City's Planning Manager has prepared a written report to the <br />Planning Commission on the cost to administer a Land Use Certificate program for exterior <br />pay telephones; and <br /> <br /> WHEREAS, according to the Planning Manager's written report to the Planning <br />Commission, it is estimated that approximately five and one-half staffhours at a cost of <br />$40 per hour or $220 are required to process a completed application for a Land Use <br />Certificate for an exterior telephone, and that these hours would be divided between <br />processing time for the Police Department, Code Enforcement, and the Planning <br />Division; and <br /> <br /> WHEREAS, based upon this report, the Council finds that a Land Use Certificate <br />application fee of $150 for the first exterior telephone and $25 for each additional phone <br />proposed represents a fair and equitable fee which is reasonably related to the City's cost <br />in administering the Land Use Certificate Program for exterior pay telephones; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA, that the application fee for a Land Use Certificate to install an <br /> <br /> <br />
