604 <br /> <br />34 and 41 of the Santa Aha Municipal Code, which pertain to the <br />subdivision of land, and the provisions of the State of <br />California Subdivision Map Act. <br /> <br />Co <br /> <br />The project site is physically suitable for the type and density of <br />the proposed project. <br /> <br />Tentative Tract Map No. 15748 exceeds the minimum lot size for <br />commercial development within the Central Business District- <br />Artists Village zoning district. There are no physical <br />constraints on the site to preclude the proposed live/work <br />community development. <br /> <br />The design and improvements of the proposed project will not cause <br />substantial environmental damage or substantially and avoidably <br />injure fish or wildlife or their habitat. <br /> <br />No fish or wildlife will be affected by the approval of the map <br />or by the design and improvements of the project. <br />Environmental Review No. 98-060 has been prepared for the <br />project and has identified mitigation measures aimed at <br />substantially reducing any environmental impacts associated <br />with the project to insignificant levels. Pursuant to Title <br />XIV, California Code of Regulations ~ 735.5(c) (1), after <br />considering the record as a whole, there is no evidence that <br />the proposed project will have the potential for any adverse <br />effect on wildlife resources or the habitat upon which the <br />wildlife depends. Therefore, pursuant to Fish and Game Code <br />§ 711.2 and Title XIV, CCR § 735.5(a) (3), the payment of Fish <br />and Game Department filing fees is not required in conjunction <br />with this project. <br /> <br />Eo <br /> <br />The design or improvements of the proposed project will not cause <br />serious public health problems. <br /> <br />The design and improvements associated with the project have <br />been prepared to comply with minimum City standards and have <br />been designed to mitigate any serious public health problems <br />resulting from the project. <br /> <br />The design or improvements of the proposed project will not conflict <br />with the easements acquired by the public for access through or use <br />of the property within the project. <br /> <br />Approval of Tentative Tract Map No. 15748 will not create <br />conflicts with any easements necessary for public access <br />through or within the project. <br /> <br /> 2. The mitigated negative declaration for Project No. ER 98-060 is <br />hereby approved. <br /> <br /> 3. The Mitigation Monitoring Program attached hereto as Attachment <br />B and incorporated herein by reference is hereby approved and adopted for <br />Project No. ER 98-060. <br /> <br />2 <br /> <br /> <br />
