d) Contractor shall provide transportation, labor, and supervision of packing and <br /> unpacking, installation and maintenance of coin-operated vending machines at public <br /> buildings as required. Authorization for method of installation shall be furnished to <br /> the contractor prior to shipment of machines. <br /> e) Contractor shall be responsible for installation and removal cost including all cost for <br /> move-in and move-out cost associated with this agreement. <br /> f) Contractor shall coordinate move-in dates so that the City will have uninterrupted <br /> service. <br /> g) Contractor shall provide new food and beverage vending machines ("machines") <br /> which must be new when installed and must be kept in clean, new condition. Energy- <br /> saving equipment must be used when available. <br /> h) Vendor must advise the Clerk of the Council or designee ("Clerk") of any changes to <br /> equipment. Clerk must approve any change to equipment. Equipment is subject to <br /> inspection by Clerk, if Clerk determines that equipment is not maintained in a clean, <br /> sanitary and hygienic standard deemed by the Clerk, City may provide services and <br /> bill the vendor for any cost or require new equipment or terminate this agreement. <br /> i) Contractor shall insure that all perishable products are fresh. All items dated coded <br /> must be replaced before the expiration date. Contractor will supply only brand- <br /> named items. <br />j) Contractor shall be responsible for complete maintenance including but not limited to <br /> servicing and cleaning all vending machines. <br /> k) Contractor shall provide the Clerk with a schedule of routine maintenance and <br /> cleaning for all vending machines. <br />1) Contractor shall provide a toll free number for maintenance problems. The toll free <br /> number shall be provided within thirty (30) days of the effective date of the resulting <br /> contract. <br />m) The Contractor shall provide maintenance service during all hours that City facilities <br /> are open. Contractor shall respond to calls within four (4) hours from the time a <br /> service call is placed and one (1) hour for emergency calls. Contractor shall provide <br /> for the collection of all money deposited within the vending machines at regular <br /> intervals during each locations business hours. <br />n) Contractor shall furnish a malfunction incident report to the City upon completion of <br /> each maintenance call. The report shall include as a minimum the following: (I) date <br /> and time notified, (2) date and time of arrival, (3) Type of machine, (4) description of <br /> malfunction, (5) remedy. <br />o) Contractor shall provide a refund policy for any money lost due to vending machine <br /> error. <br />p) Contractor shall pay all federal, state and local taxes which may be assessed against <br /> Contractor's equipment or merchandise while in or upon the premises of City, as well <br /> as all federal, state and local taxes assessed in connection with the operation of its <br /> vending services upon the premises. <br />q) Contractor shall comply with all federal, state, and local laws and regulations <br /> governing the preparation, handling and service of foods, and to procure and keep in <br /> effect all necessary licenses, permits, and food handler's cards required by law, and <br /> post such permits within the catering areas as required by law. <br /> <br /> <br />
