B. Customer Responsibilities: <br /> 1. Customer shall designate a Customer Representative as the point of contact to <br /> interact with Contractor regarding to the Scope of Work. <br /> 2. Customer shall furnish Contractor with blueprints, surveys, legal descriptions of the <br /> site, and other information regarding the Facilities as Contractor may reasonably request <br /> in order to complete Scope of Work and maintain the Guarantee provided said <br /> documents are readily available to Customer. These shall not become the property of <br /> Contractor and shall be returned to Customer, unless otherwise requested by Contractor, <br /> in which case Contractor shall bear the cost of all blueprints and copies necessary to <br /> perform the Scope of Work in this Agreement. <br /> 3. Customer shall within ten (10) business days, respond to samples or documents <br /> submitted by Contractor to the Customer for review and approval under this Agreement. <br /> 4. Customer shall provide reasonable access to City facilities in order to accomplish the <br /> Scope of Work. <br /> 5. Customer shall operate equipment according to the manufacturer's recommendations. <br /> 6. Customer shall notify Contractor in writing of any City policies that may affects the <br /> Scope of Work. <br /> 7. Customer shall notify Contractor of any unusual operating conditions. <br /> 8. Customer shall remove, replace or refinish buildings structures if required by <br /> Contractor to gain access to equipment. <br /> 9. Customer shall control and/or operate all equipment necessary to perform the <br /> services herein described as arranged with Contractor representative. <br /> 10. Customer shall properly dispose of used oil, filters, contaminated absorbents and <br /> contaminated refrigerants. <br /> 11. Customer shall provide and maintain a voice grade dial-up phone line for the <br /> purpose of remote access and install a terminal block in a mutually agreed upon <br /> location. <br /> <br />Section 3. TERM. <br /> <br />This Agreement shall commence on the date first written above and terminate on March 1, 2014, <br />unless terminated earlier in accordance with the provisions as set forth below. <br /> <br />Section 4. PAYMENT <br /> <br />Total installation job costs for complete scope of work, including $35,000.00 feasibility study is <br />$2,887,120.00. The Customer will make progress payments as provided below: <br /> <br />Date Payment Amount <br />Project Mobilization 30% $866,136.00 <br />The Project Mobilization $1,732,272.00 <br />Payment will revert to a <br />Mutually Approved Schedule <br /> <br /> <br />
