<br />INSURA~CE ON FILE <br />.'::~"" ;VIP,Y PROCEED <br />UNTIL INSURANCE EXPIRES <br />If} J ,3/JCt'! <br />CLERK OF COUNCIL <br />DATE:$- ;u.-{)'t <br /> <br />A-2004-012 <br /> <br />c,:fWP <br />[:r: .o4Þ'W] <br /> <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br /> <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />on January 20, 2004, by and between National Plant Services, Inc., a California <br />corporation ("Consultant") and the City of Santa Ana, a charter city and municipal <br />corporation of the State of California ("City"). <br /> <br />Recitals: <br /> <br />A. The parties entered into an Agreement dated December 9, 2003, (hereinafter "said <br />Agreement") by which Consultant has provided catch basin inspection and cleaning <br />services. <br /> <br />B. In accordance with the terms and conditions of the Agreement, the parties wish to <br />renew the Agreement for an additional one-year period and to increase compensation <br />to pay for inspection and cleaning services for additional catch basins. <br /> <br />Wherefore, in consideration of the covenants contained in the Agreement, and subject to <br />all the terms and conditions of the Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 1, SCOPE OF SERVICES, shall be amended to read as follows: <br /> <br />"Consultant shall provide those services as set forth in Exhibit A-I, attached to this <br />Amendment." <br /> <br />2. Section 2, COMPENSATION, shall be amended to increase total compensation by <br />$45,000.00 for a total not to exceed amount of $54,950.00, during the term of said <br />Agreement. <br /> <br />3. Section 3, TERM, shall be amended to extend the term for an additional one year to <br />October 31, 2005. <br /> <br />3. The parties agree that work to be performed pursuant to said Agreement is a <br />municipal affair and not subject to State Prevailing Wage requirements. Consultant <br />agrees to indemnify and hold harmless, City from any third party claim that this is a <br />public work project requiring payment of prevailing wages. <br /> <br />II <br /> <br />II <br /> <br />II <br />
