<br />14.5 <br /> <br />14.6 <br /> <br />defend, indemnify and save harmless the City of Santa <br />Ana, its officers and employees, from any and all claims, <br />demands, suits, actions or proceedings of any kind or <br />nature, including, but not by way of limitation, workers' <br />compensation claims, resulting from or arising out of the <br />negligent acts, errors, or omissions, or arising out of <br />the intentional or malicious acts of Association's <br />representative. <br /> <br />The Association and the City of Santa Ana agree that the <br />Association's representati ve will not be required to <br />carry out any peace officer's duties during such time <br />that the Association's representative is on such full- <br />time release from duty. The Association's representative <br />will be required to comply with the Rules and Regulations <br />of the Santa Ana Police Department as they apply to off- <br />duty employees, except such representative will not be <br />required to report for duty for any purpose. <br /> <br />Upon return to duty from such full-time release, the <br />Association's representative shall be restored to the <br />same position without loss of any benefits as he or she <br />would have occupied or accrued if there had been no <br />disruption in duty status. <br /> <br />The Association agrees that since the Association <br />representative does not report for duty or account to the <br />City for his or her sick leave or vacation time, that <br />vacation and sick leave accruals shall be treated as <br />follows: <br /> <br />A. <br /> <br />The Association representative shall accrue eight <br />(8) hours of sick leave each month until the <br />accrued sick leave total reaches a maximum of 1600 <br />hours. <br /> <br />B. <br /> <br />vacation shall be accrued consistent with existing <br />POA MOU provisions. The Association <br />representative may not carryover from one (1) <br />calendar year to the next more than the equivalent <br />of one (1) longevity vacation period and the <br />equivalent of one (1) regular vacation period from <br />the previous two (2) years. Regular vacation in <br />excess of that accrued during the previous two (2) <br />year period will be forfeited. <br /> <br />c. <br /> <br />The Association representative may not donate <br />his/her accrued vacation or holiday time. <br /> <br />60 <br />
