Should the City enact some form of <br />utility taxes and it is determined <br />that it applies to Great Western <br />Reclamation activities, there be <br />no further obligation to pay this <br />amount. <br /> <br />The motion further included instruction to the City Attorney to <br />prepare the necessary documentation to implement the Council's <br />action. <br /> <br />Council consensus was that any future rate increase request <br />from Great Western, other than those provided in the present <br />contract related to the cost-of-living index, would result <br />in a new bid call by the City for trash collection service. <br /> <br />Councilman Yamamoto stated that there was a possibility he had <br />a conflict of interest because he had received a commission <br />(approximately $45) as a result of a life insurance policy sale <br />to an employee of Great Western two or three years ago. He <br />indicated approval of the stock transfer could result in can- <br />cellation of the insurance policy. <br /> <br />The City Attorney opined that it did not constitute a legal <br />conflict of interest. <br /> <br />A motion by Councilman Griset, seconded by Councilman Garthe <br />to make a finding that Councilman Yamamoto had a conflict of <br />interest, and should therefore be disqualified from participa- <br />tion in the Council decision, was seconded by Councilman Garthe. <br />The motion failed to carry on the following roll call vote: <br /> <br />AYES: Griset, Garthe, Markel <br /> <br />NOES: Ward, Patterson <br /> <br />ABSTAINED: Evans, Yamamoto <br /> <br />ABSENT: None <br /> <br />The City Attorney ruled that Councilman Evans could not abstain <br />from voting and that his abstention should be counted as a "No" <br />vote. (The tie vote, in effect, determined that Councilman <br />Yamamoto did not have a conflict of interest and must therefore <br />vote on the matter.) <br /> <br />A motion to conduct a public hearing on the request for approval <br />of the stock transfer at the next regular Council meeting, <br />November 19, made by Councilman Evans, seconded by Councilman <br />Garthe, failed to carry on the following roll call vote: <br /> <br />AYES: Evans, Garthe, Markel <br /> <br />NOES: Griset, Ward, Patterson, Yamamoto <br /> <br />ABSENT: None <br /> <br />The following persons spoke in favor of the request: <br /> <br />Warren Sikora, Attorney, 888 North Main Street, <br />representing the Blackman Family and Great <br />Western Reclamation; <br /> <br />Roger Howell, Attorney, 401 Civic Center Drive <br />West, representing SCA Services; <br /> <br />CITY COUNCIL MINUTES 4:16 NOVEMBER 5, 1973 <br /> <br /> <br />
