These <br />changes have been made to be consistent with the task description and <br />NEPAlCEQA, and to move the deliverables for the FEIS/EIR from Task 4. <br /> <br />Task11- <br /> <br />Development of Findings of Fact, Statement of Overriding <br />Considerations, Certification, Record of Decision, and Notice of <br />Determination <br /> <br />This task involves the development of Findings of Fact, if it is determined that the <br />project would result in one or morè significant environmental impacts, and a <br />Statement of Overriding Considerations, if it is determined that the project would <br />result in one or more environmental impacts that would still be significant even <br />after mitigation. If the project would result in one or more such environmental <br />impacts, then the CONSULTANT will develop written findings for each of those <br />significant effects. The Findings of Fact and Statement of Overriding <br />Considerations will identify why the benefits of the project outweigh the <br />unavoidable significant impacts. A separate finding must be made for each <br />significant effect. The Statement of Overriding Considerations shall be supported <br />by substantial evidence in the record. The Statement will be included in the <br />record of the project approval and will be mentioned in the Notice of <br />Determination. <br /> <br />To comply with NEPA, the CONSULTANT will prepare a Record of Decision for <br />FTA to send to the EPA to indicate that FTA has made a final decision on the <br />environmental document. <br /> <br />18 <br />
