1&'LexisNexisrm 15 SELECTIVE AND LIMITED DISTRIBUTION LEGAL ADDENDUM FOR QUALIFIED ACCESS SERVICES LexisNexis, a division of Reed Elsevier Inc. ( "LN ") and Santa Ana Police Department ( "Subscriber') hereby agree to revise the Subscription Agreement ( "the Agreement') previously or simultaneously executed by and between LN and Subscriber by adding to the Agreement the terms and conditions set forth below. TERM; TERMINATION 1.1 The term of this Addendum shall begin on the last date written below ( "Effective Date ") and shall continue until the Agreement terminates, unless sooner terminated by either party in accordance with Section 1.2 below (the "Term "). 1.2. Either party may terminate this Addendum on the first day of any calendar month by giving the other party at least ten (10) days prior written notice. 2. SELECTIVE AND LIMITED DISTRIBUTION MATERIALS During the Term, LN shall provide Subscriber with access to and use of selective and limited distribution materials in accordance with the terms and conditions set forth below. These materials include but are not limited to all LN non - public information products that display Social Security Numbers ( "NPI SSN Products "). 3. AUTHORIZED USERS; AUTHORIZED USE In o rder to a ccess a nd use the N PI S SN P roducts, S ubscriber m ust be a n organization, agency, entity or individual (an "Authorized User') set forth on Exhibit A attached hereto and hereby incorporated by reference. Subscriber shall check the appropriate line item on Exhibit A that best describes it as an Authorized User. In order to access and use the NPI SSN Products, Subscriber must also indicate an authorized use ( "Authorized Use ") of the NPI SSN Products by checking the appropriate line item(s) on Exhibit A that best describes its Authorized Use. In the event LN amends the authorized users or authorized uses line items on Exhibit A, upon request by LN, Subscriber will re- certify the information on Exhibit A. 4. CERTIFICATION 4.1. Subscriber hereby certifies that on the Effective Date it is an Authorized User for purposes of accessing and using one or more of the following Products, including, but not limited to, the SELECT library, EZFIND, ALLFIND, P -TRAK, P -SEEK, P -SRCH, PSRCH2, and Marketing Facing Applications developed by LN or its third party suppliers. Subscriber further certifies that all access to and use of these NPI SSN Products shall be an Authorized Use in accordance with Section 3 above and Exhibit A.
