<br />!\i _,'),003-0"4 - 0/ <br /> <br />AMENDMENT TO AGREEMENT <br /> <br />THIS AMENDMENT, made and entered into this i~ day of September 2004, by and between San <br />Joaquin Chemical Inc. ("Consultant") and the City of Santa Ana, a charter city and municipal corporation <br />duly organized and existing under the Constitution and laws of the State of California ("City"), <br />collectively referred to herein as "the Parties". <br /> <br />RECIIALS <br /> <br />A. The Parties entered into that certain agreement entitled "Consultant Agreement" dated September I, <br />2003, hereinafter referred to as "said Agreement", for providing general water treatment and chemical <br />services. Parties now desire to again Amend said agreement to extend the Term of and provide additional <br />compensation under the terms of said Agreement. <br /> <br />B. The Parties hereto now desire to amend the Term and Compensation sections of said Agreement in <br />order to in order to provide continuous uninterrupted service under the Agreement. <br /> <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter <br />contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, <br />the parties hereto do hereby agree as follows: <br /> <br />1. Section 2, Compensation of said Agreement, pertaining to money paid for services is hereby <br />amended to increase the amount not to exceed $9,340.00 to pay for services under said Agreement. <br />2. Section 3, Term of said Agreement, pertaining to the expiration of said Agreement is hereby <br />amended to extend the tern from September 1, 2004 until September 1, 2005. <br />3. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged <br />and in full force and effect. <br /> <br />IN WITNESS WHEREOF, the parties hereto have executed this Amendment to said Agreement the <br />date and year first above written. <br /> <br />~~.~/ <br /> <br />PATRICIA E.
