<br />A-2004-202 <br /> <br />INSURANCE NQT UN FILE <br />WORK MAY NQI PROCEED <br />CLERK OF COUNCIL <br />DATL~/1510't <br /> <br />CONSULTANT AGREEMENT <br /> <br />0, v~'" <br />. ,J J <br />l~'~o)J1 <br /> <br />THIS AGREEMENT, made and entered into this 1A day of tkjoh-€Y, 2004 by <br />and between Families Together of Orange County (hereinafter "Consultant"), and the City of <br />Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California (hereinafter "City"), <br /> <br />RECITALS <br /> <br />A. The City, as a grantee of the United States Department of Justice Weed and Seed Grant <br />A ward, pursuant to Title I of the Omnibus Crime Control and Safe Streets Act of 1968, <br />42 u,s,c. 3701, et. seq, (hereinafter "the Act"), desires to enter this Agreement with <br />Consultant for the expenditure of Weed and Seed Grant funds to provide instruction in <br />computer technology, <br /> <br />B. Consultant represents that it is able and willing to provide such services to the City, <br /> <br />C, The City and Consultant have duly executed this Agreement for expenditure of said <br />funds, <br /> <br />NOW THEREFORE, it is agreed by and between the parties that the foregoing Recitals are a <br />substantive part of this Agreement and the following terms and conditions are approved and, <br />together with all exhibits and attachments hereto, shall constitute the entire Agreement between <br />the City and Consultant: <br /> <br />1. SCOPE OF SERVICES <br /> <br />Consultant shall provide instruction in computer technology for residents living in the <br />Empowerment Zone II, as set forth in Exhibit A to this Agreement. <br /> <br />2. COMPENSATION <br /> <br />a, City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The total sum to be expended under this <br />Agreement shall not exceed $16,000,00 during the term of this Agreement. <br /> <br />b, Payment by City shall be made within thirty (30) days following receipt of proper <br />invoice evidencing work performed, subject to City accounting procedures, Payment need not <br />be made for work which fails to meet the standards of performance set forth in the Recitals <br />which may reasonably be expected by City, <br /> <br />3. TERM <br /> <br />This Agreement shall commence on October 1,2004 and terminate on September 30, <br />2005, unless terminated earlier in accordance with Section 14, below, The term of this <br />
