<br />INSURANCE NUT ON fiLE <br />WORK MAytiOI PROCEED <br />CLERK OF COUNCIL <br />DATE~ 8-4-05 <br /> <br />A-2005-034 <br /> <br />DO NOT RECORD <br /> <br />D: Ct>A- <br />(C.I1.JI~) <br /> <br />LEASE AGREEMENT <br />BETWEEN <br />THE CITY OF SANTA ANA <br />AND <br />LENNAR HOMES, INC. <br /> <br />THIS AGREEMENT ("Agreement") is made and entered into this ~ day of <br />February, 2005, by and between the City of Santa Ana, a charter city and municipal <br />corporation, duly organized and exiting under the constitution and laws of the State of <br />California, herein referred to as "Landlord", and Lennar Homes of California, Inc, a <br />California Corporation, herein referred to as "Tenant". <br /> <br />The parties hereto agree as follows: <br /> <br />ARTICLE 1 - TERM OF LEASE <br /> <br />Section 1.01 Premises and Use <br /> <br />(a) Landlord owns the real property described in Exhibit "A" attached hereto and <br />made a part hereof (the "Property"), commonly know as The Depot at Santa <br />Ana located at 1000 East Santa Ana Boulevard, Santa Ana, California. <br />Landlord hereby rents to Tenant sole use of the area designated as the 5th <br />Floor of The Depot (the "Premises") for Tenant's business purposes. Tenant <br />shall have the right to alter the Premises to accommodate Tenant's intended <br />use which includes, but is not limited to painting the interior and replacing <br />carpeting per Tenant's management requirements, at Tenant's sole cost, <br />subject to Landlord's prior approval, which shall not be unreasonably <br />withheld. Tenant's modifications shall to comply with all local permit <br />requirements. <br /> <br />(b) Tenant's use of the Premises shall be comprised of office hours of 10:00 a.m. <br />until 6 p.m., Monday through Sunday. For any use exceeding such hours shall <br />be subject to 7 days prior notice to Landlord, with Tenant required to pay <br />Landlord's costs for such extended usage. <br /> <br />(c) Tenant hereby accepts the Premises in their condition existing as of the <br />Commencement Date ofthis Agreement. <br /> <br />(d) Any signage Tenant intends to place upon the Premises is subject to prior <br />approval ofthe Landlord, and must be compliant with The Depot guidelines <br />as well as City of Santa Ana local regulations. <br /> <br />(e) Upon the expiration or termination of this Agreement, Tenant shall surrender <br />the Premises to Landlord in good and clean condition, less ordinary wear and <br />tear. <br />
