<br />A-2004-176-06 <br /> <br />I <br /> <br />2 <br /> <br />AGREEMENT TO TRANSFER OR PURCHASE EQUIPMENT OR SERVICES <br /> <br />3 C;PD <br />rj.tt~ <br /> <br />Including Services and Technology Specifically Required Under the <br /> <br />4 <br /> <br />INTEGRATED LAW AND JUSTICE PROJECT <br />FOR FY04 URBAN AREA SECURITY INITIATIVE (UASI) <br /> <br />5 <br /> <br />6 <br />7 <br />8 <br />9 <br /> <br />THIS AGREEMENT is entered into this 11i:i.-day oJ~~ . 2005, which <br /> <br /> <br />date is enumerated for purposes of reference only, by and between the CITY F SANTA ANA, a <br /> <br /> <br />municipality of the State of California, hereinafter referred to as "CITY", and the CITY OF Newport <br /> <br /> <br />Beach, acting as Lead Agency for the Orange County Integrated Law and Justice (IL&J) project, <br /> <br /> <br />hereinafter referred to as "SUBGRANTEE." <br /> <br />10 <br />11 <br />12 <br /> <br />WHEREAS, CITY, acting through the Santa Ana Police Department in its capacity as the Core <br /> <br /> <br />City for the Santa Ana Urban Area under the FY04 Urban Area Security Initiative, has applied for, <br /> <br /> <br />received and accepted a grant entitled "FY04 Urban Area Security Initiative" from the federal <br /> <br /> <br />Department of Homeland Security, Office of Domestic Preparedness, through the State of California, <br /> <br />13 <br />14 <br /> <br />IS <br />16 <br />17 <br />18 <br /> <br />Office of Homeland Security, to enhance countywide emergency preparedness, hereinafter referred to as <br /> <br />"the grant," as set forth in the grant guidelines that are attached hereto as Attachment A and incorporated <br /> <br />herein by reference. <br /> <br />19 <br /> <br />WHEREAS, the terms of the grant require that CITY use certain grant funds to purchase, or <br />reimburse SUB GRANTEE for the procurement of, equipment, technology or services that will be <br />transferred to SUB GRANTEE to be used for grant purposes, including the transfer of technology to <br />Orange County Police Agencies under the Urban Area Security Initiative. <br /> <br />20 <br />21 <br />22 <br /> <br />23 <br /> <br />NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> <br />24 <br /> <br />1. <br /> <br />Effective January 23, 2004, SUB GRANTEE was designated as the lead agency and grant <br /> <br />25 administrator for the monies allocated by the federal government for the Orange County Integrated Law <br />26 and Justice Project (ILJ), a countywide effort and multi-phase project to integrate the diverse <br />27 information systems of all criminal justice agencies in the county pursuant to a COPS MORE grant. <br /> <br />28 These grant monies are held by SUB GRANTEE on behalf of the ILJ Steering Committee. The ILJ <br />
