<br />reimbursement to Grantee will be the PEG capital support payments referenced above in <br />paragraph (B)(7) of Section I. <br /> <br />2. During the term of this Agreement, Grantee may be requested by Grantor <br />to provide Coaxial I-Net service to a currently unserved site built by the Santa Ana Unified <br />School District or by Santa Ana College and to any City or County building that is located in <br />Grantee's franchise service area. In addition, Grantor may request Grantee to provide a direct <br />fiber connection to the Information Technology Department of the Santa Ana Unified School <br />District located at 160 I East Chestnut A venue. Upon request, Grantee will provide an estimate <br />of cost to design, construct, install, and maintain related Coaxial I-Net cables to the sites in <br />question, provided that such estimate can be prepared by Grantee without incurring unreasonable <br />expense. Grantor and Grantee will mutually determine whether the cost to connect is feasible <br />and whether funding can be obtained by the interested parties. <br /> <br />3. Grantee has no obligation to pay for or to provide trenches for any cable <br />necessary to comply with the requirements ofthis paragraph (E) to provide Coaxial I-Net service <br />for any new or future site. Cable may be placed in utility trenches opened by contractors during <br />the course of construction. <br /> <br />4. The Coaxial I-Net user is responsible for the installation, operation, and <br />maintenance of terminal and interface equipment within the public building, including equipment <br />for modulating reverse signals associated with PEG channels. Grantee will install, operate, and <br />maintain all cable and network components outside the public building in accordance with the <br />maintenance requirements ofthis Agreement. At its discretion, Grantee will make available to <br />Coaxial I-Net users any surplus equipment that may be used in operating or maintaining the <br />Coaxial I-Net. <br /> <br />F. Grantee's Compliance with Performance Standards <br /> <br />I. Grantee must operate and maintain the I-Net in a technically feasible <br />manner that is consistent with the funding provided for in this Section II, and subject to the <br />availability of replacement parts, as long as Grantor and its designated users continue their active <br />use ofthe Coaxial I-Net. <br /> <br />2. If Grantor determines that the Coaxial I-Net is not being operated and <br />maintained in accordance with the applicable provisions referenced in this Agreement, Grantor <br />will provide to Grantee a written notice of that deficiency and request that the deficiency be <br />cured within 30 days of the date of the notice. If Grantor determines that any deficiency has not <br />been cured at the end ofthat time period, Grantor may request in writing a meeting with <br />representatives of the Grantee to be held within 30 days of that written request. If the deficiency <br />is not cured within 15 days after that meeting, or such longer time as may be afforded by the <br />Grantor, then Grantee may be deemed to be in material breach of this Agreement and may be <br />subject to penalties or to forfeiture of the franchise as set forth in this Agreement. <br /> <br />G. Restrictions and Conditions Related to Coaxial I-Net Use. <br /> <br />]. Resale.
