<br />Attachment A <br /> <br />Part Four - Performance Period Activities, Continued <br /> <br />Freedom of <br />Information <br />Act (FOIA) <br /> <br />The state recognizes that much of the information submitted in the course of <br />applying for funding under this grant, or provided in the course of its grant <br />management activities, may be considered law enforcement sensitive or <br />otherwise important to national security interests. This may include threat, <br />risk, and needs assessment information, and discussions of demographics, <br />transportation, public works, and industrial and public health infrastructures. <br />While this information is subject to requests made pursuant to the Freedom of <br />Information Act, 5 U.S.C. Sect. 552 (FOIA), and California's Public Records <br />Act, all determinations concerning the release of information of this nature <br />will be made on a case-by-case basis by the state, and may fall within one or <br />more of the available exemptions under the Act. <br /> <br />Grant recipients are encouraged to consult their own local laws and <br />regulations regarding the release of information, which should be considered <br />when reporting sensitive matters in the grant application, needs assessment <br />and strategic planning process. <br /> <br />NOTICE: The details of the grant application will be subject to the <br />provisions of the California Public Records Act (Governmental Code Section <br />6250 et seq.). This means that all, or part, of the application may be publicly <br />disclosed. While the state will make every effort to protect sensitive <br />information, it is imperative that the grant application does not contain <br />information that constituent jurisdictions or agencies believe are confidential. <br />The grant recipient's failure to protect such information from disclosure may <br />jeopardize the safety and security of the people ofthe State ofCalifomia. For <br />example, do not specifically identify potential targets, locations, and their <br />vulnerabilities if this information is not already public knowledge. While <br />bridges and shopping malls are well known, key distribution points of <br />petroleum products and data storage facilities are not. <br /> <br />Write the grant application with the expectation that it may be made publicly <br />available.
