<br />AUGUST 22, 2005 <br />PAGE30F4 <br /> <br />The applicant will have one month to submit a queuing <br />management plan to the Planning Manager. The queuing <br />management plan shall describe the traffic control and <br />fueling operation methods that the applicant will use in <br />order to eliminate all queuing intrusion. Said plan <br />shall be reviewed and approved by the Planning Manager <br />and implemented by the applicant irrunediately following <br />the Planning Manager's approval. <br /> <br />d. The City's consultant will conduct a subsequent queuing <br />intrusion study no sooner than one month from the date of <br />the approval of the queuing management plan, but no later <br />than three months from such date. <br /> <br />e. If the City consultant determines that queuing intrusion, <br />as defined above in Paragraph A has occurred a second <br />time any time during the required study period (minimum <br />five years), the City will send the applicant written <br />notification of the queuing intrusion. Upon receipt of <br />the notification, the applicant shall irrunediately cease <br />to dispense fuel from Pump 1 identified on Exhibit "A". <br />In addition, the applicant shall provide proof of the <br />submittal of a completed application(s) for the removal <br />of said pump to the proper agencies wi thin thirty (30) <br />days of receipt of the notification. The applicant shall <br />complete the removal of said pump within thirty (30) days <br />of obtain permit approval. <br /> <br />f. If the City consultant determines that queuing intrusion, <br />as defined above in Paragraph A has occurred a third time <br />any time during the required study period (minimum five <br />years) , the City will send the applicant written <br />notification of the queuing intrusion. Upon receipt of <br />the notification, the applicant shall irrunediately cease <br />to dispense fuel from Pump 2 identified on Exhibit "A". <br />In addition, the applicant shall provide proof of the <br />submi ttal of a completed application (s) for the removal <br />of said pump to the proper agencies wi thin thirty (30) <br />days of receipt of the notification.
