<br />ARTICLE X <br /> <br />10.0 OTHER LEAVES OF ABSENCE <br /> <br />10.1 Sick Leave. <br /> <br />A. Definition. Except as otherwise provided below, sick leave shall be deemed to mean <br />absence from duty of an employee because of illness, injury, medical, or dental <br />appointment that prevents the employee from performing the duties of his or her <br />position, and shall be deemed to include time in quarantine resulting from exposure <br />to a contagious disease. <br /> <br />B. Accrual. Each employee shall be entitled to, and shall earn, one (I), eight (8) hour <br />working day of sick leave for each full calendar month of service in which he is <br />employed by the City with full pay; provided, however, any absence on sick leave for <br />a period of time greater than fifteen (15) consecutive calendar days in anyone (I) <br />calendar month shall not be considered to be service entitling an employee to earn <br />sick leave as aforesaid. Subject to the other provisions in this Article, sick leave shall <br />accrue to the credit of each employee to the extent that it is not used. <br /> <br />C. Authorized Only When Necessary. Use of sick leave by City employees shall be <br />authorized as follows: <br /> <br />I. Sick leave is not a right which an employee may use at his or her discretion, <br />but shall be allowed only in cases of necessity and actual sickness or <br />disability, or as authorized in Subsection J below. <br /> <br />2. When an accepted industrial illness or injury has caused an employee's <br />absence, for which benefits are required under the State Workers' <br />Compensation Insurance and Safety Act, paid sick leave will be allowed such <br />employee during the first three (3) days of the statutory waiting period. If the <br />workers' compensation related illness or injury continues past the initial three <br />(3) consecutive days, the employee will have the three (3) used sick days <br />recredited to his or her account. Paid sick leave will continue until the fourth <br />(4th) day when the City pays the employee workers' compensation benefits for <br />such illness or injury. Ifthe employee does not have sufficient accumulated <br />sick leave at the commencement of such industrial illness or injury, they will <br />be advanced sick leave for this purpose. Subsequently, the City will deduct <br />an equal amount previously advanced from any sick leave accrued by the <br />employee until the total amount is recovered. If the employee terminates <br />before recovery of all advanced sick leave, the City will deduct the <br />unrecovered cost of sick leave from such terminated employee's final <br />paycheck, to the extent possible. <br /> <br />42 <br />
