<br />INSURANCENC:' (j,;!LE <br />WORK MAY NOT PROCEED <br />CLERK OF COUNCil <br />DA IE: 5-17 'D5 LICENSE AGREEMENT BETWEEN THE CITY OF SANTA ANA <br />AND TAQUERlA GUADALAJARA FOR THE PROPERTY <br />IDENTIFIED AS DAN YOUNG SOCCER COMPLEX CONCESSION AREA <br /> <br />A-2004-235 <br /> <br />t . f;ZtJ <br />(~~ <br /> <br />THIS AGREEMENT, made and entered into this -.3.L day of March, 2005 by and between the <br />City of Santa Ana, a municipal corporation of the State of California, ("CITY" or LICENSOR) <br />and TAQUERIA GUADALAJARA, ("LICENSEE"). <br /> <br />WITNESSETH <br /> <br />Recitals: <br /> <br />I. City desires to provide concession services to patrons of the Dan Young Soccer <br />Complex. <br />2. The City issued a Request for Proposals ("RFP") to various concession vendors. <br />3. After an evaluation process was conducted, TAQUERIA GUADALAJARA was <br />chosen to provide the services described in the RFP based upon the responsiveness of <br />their proposal. <br />2. CITY desires to license a portion of Dan Young Soccer Complex described herein to <br />operate concessions for patrons at the Dan Young Soccer Complex as set forth in the RFP <br />and response submitted by TAQUERIA GUADALAJARA. <br /> <br />1. GRANT OF LICENSE <br /> <br />a. LICENSOR hereby grants to LICENSEE, a personal, revocable, non-exclusive <br />license to enter upon the License Area (hereinafter license area or Premises) hereinabove <br />described and shown in general in Exhibit A, attached hereto and incorporated herein by <br />reference, for the purpose of providing concession services to patrons at the Dan Young City park. <br />b. Nothing contained herein is intended, nor shall it be interpreted as, a commitment or <br />pledge by the City to retain the concessions in the License Area. <br />c. City will not be held responsible for loss of, or damage to, any improvements <br />made by LICENSEE in the License Area. <br />d. This License in no way abrogates the right of City to enforce its abatement of <br />public nuisance provisions. <br /> <br />I <br />
