<br />M. CONCESSIONAIRE agrees to use methods established by the <br />CITY's Executive Director of Finance and Management Services and CITY's <br />Executive Director or Parks, Recreation and Community Services for preparation <br />and submitting of gross financial statements. Additionally, CONCESSIONAIRE <br />shall submit a year-end financial report, which outlines income and expenses for <br />each operation. The year-end report must include an auditor's opinion from a <br />certified public accountant, which indicates that the statements fairly present the <br />financial position, and results of concession operations, in conformity with <br />generally accepted accounting principles. This year-end report shall be <br />submitted within 90 days of completion of the CONCESSIONAIRE's fiscal year. <br />The City reserves the right to undertake periodic audits of CONCESSIONAIRE's <br />financial source documents concerning the concession operation, at any time <br />during the CONCESSIONAIRE's normal business hours. <br /> <br />N. CONCESSIONAIRE agrees to be responsible for all repairs to <br />interior of concession building caused by CONCESSIONAIRE's use or <br />negligence, subject to CITY approval. The cost of such repairs shall be the <br />responsibility of CONCESSIONAIRE. <br /> <br />O. CONCESSIONAIRE agrees to submit to the Executive Director of <br />Parks, Recreation and Community Services, prior to change of prices for items <br />sold, a complete list of items being sold, and the proposed price change. No <br />such change of price shall be implemented unless and until approved by the <br />Executive Director, which approval will not be unreasonably withheld. <br /> <br />P. CONCESSIONAIRE agrees to meet with CITY regularly to discuss <br />operations, menu, promotions and the like. <br /> <br />16 <br />
