<br />N-2003-084-02 <br /> <br />SECOND AMENDMENT TO AGREEMENT <br /> <br />THIS SECOND AMENDMENT, made and entered into this ~ day of A :t~ ') <br />2005, by and between the CITY OF SANTA ANA, a charter city and municipal corporation duly <br />organized and existing under the Constitution and laws of the State of California ("City") and San <br />Joaquin Chemicals, Inc. ("Contractor"). <br /> <br />RECITALS <br /> <br />A. The City and Contractor entered into that certain Agreement, entitled "CONSULTANT <br />AGREEMENT N-2003-084", hereinafter referred to as "said Agreement", dated <br />September I, 2003, for Contractor to provide water treatment, and chemical services to <br />the City. Said Agreement was amended on September I, 2004 to extend the term and <br />compensation. <br />B. The parties now desire to again amend the term and compensation of said Agreement in <br />order to provide continuous service under said Agreement as all other terms and <br />conditions remain the same. <br /> <br />WHEREFORE, in consideration of the mutual and respective promises hereinafter <br />contained and made, and subject to all the terms and conditions of said Agreement as hereby <br />amended, the parties do hereby agree as follows: <br /> <br />I. Section 2, of said Agreement, pertaining to Compensation of said Agreement is hereby amended <br />to provide an additional $9,340.00 to the agreement. <br /> <br />2. Section 3, of said Agreement, pertaining to Term of said agreement is hereby amended to extend <br />the termination date of September I, 2005, to September I, 2006, in order to provide necessary <br />continuous uninterrupted service to the City. <br /> <br />3.
