<br />li~SURANCE NOT REQUIRED <br />WORK M~Y PROCEED <br />CLERK OF COUNCIL <br />DATE: I ~ I 7 . 0 ' <br />FIRST AMENDMENT TO AGREEMENT <br />URBAN AREA SECURITY INITIATIVE (UASI) <br /> <br />11-;00'1-/7.' P).d~ <br /> <br />THIS FIRST AMENDMENT TO AGREEMENT is entered into on October <br />~, 2005, by and between the City of Newport Beach, acting through the Newport <br />Beach Police Department ("Subgrantee") and the City of Santa Ana ("City"). <br /> <br />Recitals: <br /> <br />A. The parties entered into Agreement A-2004-176-03, dated August 16, 2004 <br />(hereinafter "said Agreement") by which City, in its capacity as the Core City for the <br />Santa Ana Urban Area under the FY04 Urban Area Security Initiative (hereinafter <br />"UASI"), transferred UASI Grant Funds to Subgrantee to train and prepare <br />Subgrantee's employees for Emergency Preparedness. <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend said Agreement to provide additional grant purposes which may be <br />reimbursed by UASI Funds. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Agreement, the parties agree as follows: <br /> <br />1. Section 1 of said Agreement shall be deleted in its entirety and replaced with the <br />following: <br /> <br />"City may transfer to SUBGRANTEE, reimbursement to train members of <br />SUBGRANTEE in accordance with grant guidelines as outlined in Attachment A to <br />said Agreement. Other expenditures of SUBGRANTEE which comply with the <br />guidelines of the Homeland Security Department regarding expenditure of UASI <br />Grant Funds, including additional costs to prepare for and participate in U ASI <br />approved exercises, may be reimbursed by City upon the prior written approval of the <br />Chief of Police of City." <br /> <br />2. Section 5 of said Agreement shall be deleted in its entirety and replaced with the <br />following: <br /> <br />"SUBGRANTEE has been allocated $40,447.00 for training and exercise <br />planning/participation costs under the provisions of this agreement and guidelines <br />outlined in attachment A" <br /> <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />
