<br />. <br /> <br />A-2006-0~ <br /> <br />/P;J.L: <br /> <br />,...,...--~. ...~- - <br /> <br />FIRST AMENDMENT TO CONSULTANT AGREEMENT <br /> <br />,v)\{ <br /> <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />on January 3, 2006, by and between Kent Jorgensen ("Consultant") and the City of Santa <br />Ana, a charter city and municipal corporation of the State of California ("City"). <br /> <br />RECITALS: <br /> <br />A. The parties entered into Agreement A-2004-269, dated December 20,2004, <br />(hereinafter "said Agreement") by which Consultant has provided right-of-way <br />support services to City. <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />increase the compensation for continued to provision of services to the City. <br /> <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those an1ended in this <br />First Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 2.a., COMPENSATION, shall be amended to increase compensation by <br />$150,000 by deleting said section in its entirety and replacing with the following <br />language: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services <br />and hourly rate of $95.00. The total sum to be expended under this Agreement shall not <br />exceed $300,000.00 during the tem of this Agreement." <br /> <br />2. Section 3, TERM, shall be deleted in its entirety and replaced with the following: <br /> <br />"This Agreement shall commence on December 20, 2004 and terminate upon <br />expenditure of allocated funds, unless terminated earlier in accordance with Section 12, <br />below." <br /> <br />3.
