'7 ,2003, by and between Friess Company Builders, <br />Inc., a California corporation ("Consultant") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br /> <br /> <br />FIRST AMENDMENT TO <br />CONSULT ANT AGREEMENT <br /> <br />Recitals: <br /> <br />A. The parties entered into Agreement No. N-2002-176, dated December 23,2002, <br />(hereinafter "said Agreement") by which Consultant has provided stucco repair and <br />paint touch up to the fayade and courtyard improvements for Minnie Street properties. <br /> <br />B. Consultant has agreed to construct the fayade and courtyard improvements at the <br />properties located at 1105 and 1109 S. Minnie Street, Santa Ana, California. Said <br />improvements require submittal of architectural drawings. <br /> <br />C. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the Scope of Services to include Consultant obtaining the architect stamp for <br />the drawings needed to complete the fayade and courtyard improvements. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 1, SCOPE OF SERVICES, shall be amended to read: <br /> <br />"Consultant shall perform stucco repair and paint touch up ofthe building facades as <br />set forth in Exhibit A to said Agreement. Additionally, Consultant shall procure the <br />architectural drawings required for the completion of the work on the building <br />facades at 1105 and 1109 S. Minnie St., Santa Ana, California." <br /> <br />2.
