'. ~D <br />fIN <br /> <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT, is entered <br />into on July I, 2002, by and between Javier Saldivar (hereinafter "Consultant") and the <br />City of Santa Ana (hereinafter "City"). <br /> <br />Recitals: <br /> <br />A. The parties entered into an Agreement dated July 28, 2000, (hereinafter "said <br />Agreement") by which Consultant has provided counseling and instructional services <br />to imnates housed in the Santa Ana Jail. <br /> <br />B. Said Agreement was extended for one year, to June 30, 2002, by a letter agreement. <br /> <br />C. In accordance with the terms and conditions of said Agreement, the parties wish to <br />renew said Agreement for an additional one year period and to increase the hourly <br />rate of compensation for services provided. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />I. Paragraph 2.a. COMPENSATION, shall be amended to read as follows: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />an hourly rate of thirty-seven dollars ($37.00) for all scheduled instructional and <br />counseling sessions. Compensation shall be increased $10,000.00 to pay for services <br />provided during the extended term of this Agreement. The total sum to be expended <br />under this Agreement, shall not exceed $ I 6,500.00 during the term of this <br />Agreement." <br /> <br />2. Paragraph 3, TERM, shall be amended to read as follows: <br /> <br />"This Agreement shall commence on July 28, 2000 and terminate on June 30, 2003, <br />unless terminated earlier in accordance with Section 12, below. The term of this <br />Agreement may be extended upon a writing executed by the Chief of Police and the <br />City Attorney." <br /> <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />
