<br />(;Pt6 <br />RIJ <br /> <br />AMENDMENT TO AGREEMENT <br /> <br />N-2002-131 <br /> <br />THIS AMENDMENT, made and entered into this 33 /uk day of September 2002, by and between <br />Santa Ana Winds ("WINDS") and the City of Santa Ana, a charter city and municipal corporation duly <br />organized and existing under the Constitution and laws of the State of California ("City"), collectively <br />referred to herein as "the Parties". <br /> <br />:2 <br />(~ <br /> <br />RECIIALS <br /> <br />A. The Parties entered into that certain agreement entitled "AGREEMENT BETWEEN THE CITY <br />OF SANTA ANA AND THE SANTA ANA WINDS BAND" dated March 29,2001, hereinafter <br />referred to as "said Agreement", for providing rental assistance to WINDS for the storage of equipment <br />and uniforms. <br />B. The Parties hereto now desire to amend the Compensation term, of said Agreement in order to in <br />order to provide continuous uninterrupted service under the Agreement. <br /> <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter <br />contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, <br />the parties hereto do hereby agree as follows: <br /> <br />1. Section 2, of said Agreement, pertaining to "Compensation" term is hereby amended to reflect an <br />increase in the reimbursement rate from two hundred dollars ($200.00) per month to a <br />reimbursement rate of three hundred dollars ($300.00) per month. ) due to an unexpected increase <br />in the WINDS's monthly rent as provided in said Agreement. The total sum to be expended under <br />said Agreement shall not exceed six thousand four hundred ($6,400.00). <br /> <br />2. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged <br />and in full force and effect. <br /> <br />IN WITNESS WHEREOF, the parties hereto have executed this Amendment to said Agreement the <br />date and year first above written. <br /> <br />ATTEST: <br /> <br />p~ <br /> <br />PATRICIA E.
