THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT, is entered <br />into this /'1 t1.. day of /v14 Y , 2003, by and The Reynolds Group, a California <br />corporation ("Consultant") ahd the City of Santa Ana, a charter city and municipal <br />corporation of the State of California ("City"). <br /> <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br /> <br />Recitals: <br /> <br />A. The parties entered into Agreement No A-2002-089, dated June 3, 2002, (hereinafter <br />"said Agreement") by which Consultant has provided soil sampling and analyzing of <br />underground tanks located at City fire stations. <br /> <br />B. Upon performing services pursuant to said Agreement, it was discovered that <br />additional samples and testing were necessary for the underground tanks located at <br />fire stations 2 and 8. <br /> <br />C. The parties now desire to amend said Agreement to increase the compensation to pay <br />for additional services performed pursuant to said Agreement and to extend the term <br />of said Agreement. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 2 a., COMPENSATION, shall be amended to read as follows: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The total sum to be expended under this <br />Agreement shall not exceed $22,901.25 during the term of this Agreement." <br /> <br />2. Section 3, TERM, shall be amended to read as follows: <br /> <br />"This Agreement shall commence on June 3, 2002 and terminate on June 30, 2003, <br />unless terminated earlier in accordance with Section 12, below. The term of this <br />Agreement may be extended upon a writing executed by the Fire Chief and the City <br />Attorney." <br /> <br />3. Except as hereinabove modified, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />
