The City will rehabilitate and repair the building site located at 124 S. Bristol Street, Santa Ana (hereafter referred to as the replacement site) in accordance with the attached Scope ofW ork, identified as Attachment 1. The City will enter into a contract with Gates Development Co. to complete said Scope of Work in a timely manner. 2. The relocation costs of$129, 656 are considered a relocation claim by the Claimant, in accordance with 49 CFR Part 24. Claimant authorizes payment of the relocation claim directly to Gates Development Co., as specified in the Attachment 2. 3. Gates Development will assist the Claimant in relocating personal property located at 204 N. Bristol Street to the'replacement site. These moving costs are included relocation claim outlined above. Claimant's occupancy at the replacement site will be in accordance with a separate Non-Exclusive License Agreement. 4. Neither the City nor any employee, officer, or agent thereof shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by Claimant under or in connection with the agreement. It is also understood and agreed that the Claimant shall fully indemnifY and hold the City and their consultants, harmless for any liability imposed by injury or damage to property occurring by reason of anything done or omitted by Claimant in connection with this agreement. 5. All notices, requests, demands and other communications required or permitted to be given under this Agreement shall be in writing and shall either be delivered in writing personally or be sent by telegram or by regular or certified first class mail, postage prepaid, deposited in the United States mail, and properly addressed to the party at its address set forth below, or at any other address that such party may designate by written notice to the other party: To City: City of Santa Ana Public Works Agency Sauri Amirani 20 Civic Center Plaza M-36 Santa Ana, CA 92702 To Tenant: Johnson Chapel Attn: Pastor Barta P.O.
