DATE: S—( (¢ — 0(o A-2006-112 CONSULTANT AGREEMENT THIS AGREEMENT, made and entered into this 1" day of May, 2006 by and between Lien On Me Medical Bill Review, Inc., a California corporation (hereinafter "Consultant"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California (hereinafter "City"). RECITALS A. The City currently utilizes an independent preferred provider network in its Self - Funded Workers' Compensation Program to have cost control measures through contracted provider and facility rates, including a formal auditing system of all medical provider billings. B. Consultant is experienced, knowledgeable and has the personnel and systems capable of providing the medical fee review process, contract medical providers, facilities, and retrospective re -pricing process. C. City desires to retain Consultant to perform the services desired by City to analyze medical bills and secure potential cost savings. D. In undertaking the performance of this Agreement, Consultant represents that it is knowledgeable in its field and that any services performed by Consultant under this Agreement will be performed in compliance with such standards as may reasonably be expected from a professional consulting firm in the field. NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the terms and conditions hereinafter set forth, the parties agree as follows: 1. SCOPE OF SERVICES Consultant agrees to provide a comprehensive medical bill analysis and cost containment service, utilizing all reasonable and applicable cost containment and management methodologies. These methodologies shall include a four -tier Preferred Provider Organization (PPO) system. Of the four PPOs pre -selected by the City, if the pre -designated primary PPO offers no discount, Consultant's system will check with the remaining three PPOs until a discount is applied if available. Out of Network negotiations and reduction to Fee Schedule will be applied where applicable. Consultant guarantees a five -business -day turnaround on all batches of bills received from the City, if all required data has been submitted by City. Consultant shall not charge a bill review service fee to or seek compensation from the City for services rendered outside said five - business -day turnaround time. City shall be responsible for payment of appropriate PPO fees charged.
