In the event an overpayment owing by <br />2 CONTRACTOR is collected from COUNTY by the fundi ng source, then CONTRACTOR <br />3 sha 11 rei mburse COUNTY withi n thi rty (30) days thereafter, and pri or to any <br />4 administrative appeal process. CONTRACTOR agrees to pay all costs incurred by <br />5 COUNTY necessary to enforce the provisions set forth in this paragraph. <br />6 19. REVENUE <br />7 Whenever CONTRACTOR recei ves any money specifi ca lly desi gnated for use <br />8 in programs funded through this Agreement. such monies shall be considered a <br />9 cost off-set and treated as a reduction against the amount claimed by <br />10 CONTRACTOR, except for Program Income as defined in 45 CFR, Section 92.25 as <br />11 that section currently exists or may be hereafter amended. The procedure for <br />12 designating money as Program Income is set forth in Paragraph 20 of this <br />13 Agreement. <br />14 20. PROGRAM INCOME <br />15 It is mutually understood that the State or Federal agency responsible <br />16 for providing the funding for this Agreement may designate certain revenue of <br />17 CONTRACTOR as Program Income. To be designated as Program Income and, <br />18 therefore. as other than a cost off-set. CONTRACTOR shall do all of the <br />19 following: <br />20 20.1 Submit a plan to ADMINISTRATOR for the use of any and all proposed <br />21 Program Income; <br />22 20.2 Set up and ma i ntai n a separate bank account for any proposed <br />23 Program Income and account for any and all such income received; and <br />24 20.3 Report to ADMINISTRATOR any and all Program Income received no <br />25 1 ater than thi rty (30) days from the date of recei pt; record the amount <br />26 recei ved on i nterna 1 fi nanci a 1 records; and i ndi cate the amount recei ved on <br />27 the monthly claim submitted to ADMINISTRATOR. <br />28 / / / <br /> <br />(WBC0406) <br /> <br />25 of 37 <br /> <br />(4/19/2006) <br />
