The parties entered into Agreement #2004-038, dated March 30, 2004, (hereinafter <br />"said Agreement") by which Consultant has operated and managed the City's public <br />parking garages. <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend said Agreement for an additional one-year term and to increase total <br />compensation to pay for services during the extended term. <br /> <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Second Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 2.a, COMPENSATION, shall be deleted in its entirety and replaced with the <br />following: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />a Management Fee in the amount of Nine Hundred Ninety Five Dollars ($995.00) per <br />month, as set forth in Exhibit A to said Agreement. The total sum to be expended <br />under this Amendment to Agreement shall not exceed $11,940.00, during the term <br />from May 1,2006 through April 30, 2007." <br /> <br />2.
