P{Ov-e,s) <br /> <br />A-2006-151 <br /> <br />SECOND AMENDMENT TO <br />CONSULTANT AGREEMENT <br /> <br />THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into on June 19,2006. by and between The Ferguson Group, L.L.c. ("Consultant") and <br />the City of Santa Ana, a charter city and municipal corporation of the State of California <br />("City"), <br /> <br />RECITALS: <br /> <br />A, The parties entered into Consultant Agreement A-2004-] 33, dated July 1,2004, <br />(hereinafter "said Agreement") by which Consultant has provided government liaison <br />services. <br /> <br />B. In accordance with the tenns and conditions of said Agreement, the parties wish to <br />renew said Agreement for an additional one-year period and to increase compensation <br />to pay for services during the extended ten11. <br /> <br />WHEREFORE, in consideration ufthe l:ovenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Second Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />I. Section I, SCOPE OF SERVICES, shall he deleted in its entirety and replaced with <br />the following: <br /> <br />"Consultant shall perfon11 services as set lorth in Exhibit A to this Amendment to <br />Agreement." <br /> <br />2, Section 2. a, COMPENSA TION, shall be amended to increase total compensation hy <br />$75,000,00 by deleting said section in its entirety and replacing it with the following: <br /> <br />"a, City agrees to pay, and Consultant agrees to accept, compensation at the rate or <br />six thousand, two hundred, fifty dollars ($6250,00) per month for expenses and time <br />spent by Consultant in the perfon11ance of said Agreement, The total amount payable <br />under this Agreement shall not exceed seventy-five thousand dollars ($75,000.00) <br />during the 2006-2007 fiscal year." <br /> <br />3, Section 3, TERM, shall be extended lor one year, from June 30, 2006 through June <br />30, 2007, <br /> <br />4. Except as herein amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />
