<br />\ <br /> <br /> <br />_ South Coast <br />IiIlI Air Quality Management District <br /> <br />A-2002-061-01 <br /> <br />Contract No. 021541 <br />Modification <br /> <br />This modification consists of 5 pages. <br /> <br />1. RECITALS <br />A. The South Coast Air Quality Management District (hereinafter "AQMD") and the City of Santa <br />Ana (hereinafter "CONTRACTOR") have previously executed a Contract No. 02154 to purchase <br />two (2) CNG dump trucks and four (4) CNG street sweepers. <br /> <br />B. CONTRACTOR has purchased the four (4) CNG street sweepers but due to unforeseen <br />constraints, will not be able to purchase the two (2) dump trucks. In addition, it is necessary to <br />extend the term of Contract to allow for the full five (5) year reporting of the street sweepers. <br />Therefore, a modification to this Contract is necessary to extend the date by which performance <br />must be completed and decrease the maximum amount payable. <br /> <br />2. MODIFICATION - The parties therefore agree to modify the existing Contract as follows: <br /> <br />A. The term of this Contract is extended for an additional period commencing March 11, 2007 and <br />terminating November 10, 2008. <br /> <br />B. The amount payable for performance under this modification is decreased by Ten Thousand <br />Four Hundred Sixty Nine Dollars ($10,469). Attachment 2, Amendment 1 - Cost Schedule, attached hereto and included herein by this <br />reference, supersedes the original Cost Schedule. <br /> <br />E.
