<br />INSURANCE NOT REQUIRED <br />WORK MAY PROCEED <br />CLERK OF COUNCIL <br />DATE: cP-M-or <br />0: COTe (2.) <br /> <br />N_2005-123-001 <br /> <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br /> <br />lHIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into <br />on February I, 2007 by and between Cesar Vargas and the City of Santa Ana, a charter <br />city and municipal corporation of the State of California ("City"). <br /> <br />RECITALS: <br /> <br />A. The parties entered into Agreement #N-2005- 123, dated October 17, 2005, <br />(hereinafter "said Agreement") by which Consultant has provided <br />translation/interpretation services <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />increase the rate of pay and compensation and to extend the term of said agreement. <br /> <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />I. Section 2.a, COMPENSATION, shall be amended to increase Consultant's hourly <br />rate to $95.00 per hour, and increase total compensation to $25,000, annually. Said <br />section shall read in full as follows: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for his services, <br />the hourly rate of $95.00, with a two-hour minimum, which includes up to thirty (30) <br />minutes of preparation, familiarization and review time, as referenced in Section lb. <br />The total compensation to be paid pursuant to this Agreement shall not exceed <br />$25,000.00, annually, during the term of this Agreement." <br /> <br />2. Section 3, TERM, shall be deleted in its entirety and replaced with the following: <br /> <br />'The term of this Agreement shall commence October 17, 2005 and shall terminate <br />on June 30, 2008, unless terminated earlier in accordance with section 9, below. The <br />term of this agreement may be extended upon a writing signed by the City Manager <br />and the City Attorney." <br /> <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />
